Podcast Episode: The Endangered Species Act in Less Than 20 Minutes

Slide 2/10. This slide lists quick facts about the ESA, which are that 1) it was signed into law on December 28th, 1973 and that 2024 is the 51st anniversary; 2) it is a combination of both game protection and habitat conservation laws; 3) it has two major qualifications for a species to be listed, and those qualifications are that the species must be both distinct and significant.
Slide 3/10. This slide defines the concepts of distinctness and significance for listing requirements. Distinctness means that the species is reproductively isolated and can only reproduce with its own kind. Significance means that the species represents an important component in the evolutionary history of the species.
Slide 4/10. This slide breaks down Section 4 of the ESA which determines whether a species is listed as threatened or endangered. The threshold for listing a species as one or the other comes down to the severity of imperilment the species is facing. Usually, this is due to habitat loss.
Slide 5/10. This slide breaks down Section 7 of the ESA which is federal cooperation. Essentially, this section of the act requires federal entities to abide by the ESA.
Slide 6/10. This slide breaks down Section 9 of the ESA, which is prohibiting take. Take is defined by a long list of verbs, and it boils down to prohibiting people from killing, injuring, selling, or capturing listed species.
Slide 7/10. This slide breaks down Sections ten and eleven of the ESA, which are exemptions and penalties.
Slide 8/10. This slide details lessons learned throughout 51 years of the ESA, including: 1) The ESA is NOT an emergency room for imperiled species; 2) the ESA has pros and cons; 3) There is a backlog of species that warrant being listed but cannot be yet; and 4) there is little available research on the economic impacts of maintaining the ESA.
